GENERAL TERMS AND CONDITIONS

Please read the following terms and conditions carefully and observe them. We carry out sales and deliveries exclusively on the basis of our following terms and conditions. The buyer recognises these terms and conditions at the latest by placing an order; any deviations require our written confirmation.

§1 Protection of minors
By placing your order, you confirm that you have already reached the age of 18.

§2 Subject matter of the General Terms and Conditions

The subject of the General Terms and Conditions is the regulation of the contractual conditions of all contracts concluded between Markus Steinbäcker verjus-shop Onlineshop (service provider) and the customer of the Onlineshop (user or consumer). The version valid at the time the contract is concluded shall apply.

§3 Contractual relationship
Our GTC apply to the sale and delivery of goods by verjus-shop Markus Steinbäcker with registered office in 8010 Graz, Hallerschloßstrasse 22. Our electronic mail address is: office (ät) verjus-shop.com. By placing an order, the buyer agrees to these terms and conditions and is irrevocably bound by them.

§4 Conclusion of the contract
By clicking on the order button, the user accepts the general terms and conditions and makes a binding declaration to the service provider that they wish to purchase the ordered goods. The contract is concluded when the service provider confirms the order after it has been sent. The declaration is sent to the user after clicking the order button. Provided that the user provides a real e-mail address, the contract is validly concluded.

The contract is concluded in German.

§5 Product images
Product images may differ from the appearance of the delivered products due to differences in colour. Colour deviations may also occur in product images due to the different qualities of the PC technology used.

§6 Duty to provide information
1. the user is obliged to provide truthful information when registering. If the user’s data needs to be changed, in particular name, address, e-mail address, telephone number and bank details, the user is obliged to inform the online shop of these changes immediately, insofar as they are relevant for order processing.
2. if the user fails to provide this information or provides incorrect data from the outset, the service provider may withdraw from the contract if a contract has been concluded. The written form requirement is also met by sending an e-mail.
3. the service provider shall send the user an e-mail with customer information to the e-mail address provided during registration immediately after conclusion of the contract.
4. the user undertakes to inform the service provider immediately at mail (ät)[nbsp]verjus-shop.com if this e-mail does not reach him within 6 hours.

§7 Right of cancellation

Buyers who are consumers within the meaning of the Consumer Protection Act may withdraw from the purchase contract within a period of seven working days from delivery of the goods without stating a reason. In addition, the user will receive this information again by e-mail. The cancellation must be made in writing and by returning the goods in their original packaging. The user must bear the costs of returning the goods and will be refunded the purchase price already paid within 14 days to a bank account specified by the user.
Bottles opened by the customer are excluded from this right.

§8 Change of the order
Subsequent changes to the order are free of charge within 12 hours of receipt of the order and must be made in writing to mail (ät) verjus-shop.com.

§9 Foreign orders
For orders outside Austria, please enquire separately by contact form, e-mail or telephone.

§10 Offer

The online shop offers products from various producers. It is always non-binding and subject to change. The prices published on the Internet are always up to date.

§11 Prices

Unless otherwise stated, all prices are gross prices ex warehouse, including statutory VAT.

§12 Due date and late payment
1. the purchase price is due for payment immediately upon ordering, unless otherwise agreed.
2. the buyer can pay the purchase price using the payment methods specified by us.

3.2 Against invoice only for known customers
4. in the event of default, the statutory default interest and a processing fee of fee of 10 Euro will be charged.

§13 Transport risk

The seller shall choose the shipping route and the shipping method. The goods are insured during transport.
The risk shall pass to the buyer as soon as the consignment has been handed over to him.
In the event of force majeure, operational disruptions, difficulties in replacement, etc., we are entitled to amend delivery contracts accordingly or to withdraw from contracts in whole or in part without the buyer being able to derive a right to compensation.

§14 Retention of title
The delivered goods shall remain the property of Markus Steinbäcker until the purchase price has been paid in full or until all existing claims against the customer have been settled in full.

§15 Warranty and liability
The warranty is subject to the statutory provisions.
Warranty claims require that defects are reported immediately in writing to Markus Steinbäcker. The customer can make use of his claim by replacing the defective goods or by reimbursement of the purchase price paid.
Liability for slight negligence on the part of Markus Steinbäcker is excluded.

§16 Data protection

Without the customer’s consent, the provider only collects the data required to process the order and fulfil the contract. The data is stored exclusively for these purposes. The customer can request information by e-mail to mail (ät) verjus-shop.com or by telephone about the data stored about him or its blocking, modification or deletion, as far as legally permissible.

§17 Additional agreements

Additional agreements are only effective if they are made in writing.

§18 Place of jurisdiction and place of fulfilment

§19 Final clause
Should one or more provisions of these General Terms and Conditions become invalid, this shall not affect the validity of the remaining provisions.
